Welcome to HOTSPOT JA App! These Terms of Use ("Terms," "Agreement") govern your access to and use of the HOTSPOT mobile application (the "App"), website, and any related services (collectively, the "Service") provided by HOTSPOT JA App ("we," "us," "our," or "HOTSPOT JA").
Important Legal Agreement: By downloading, installing, accessing, or using the Service, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a binding legal agreement between you and HOTSPOT JA.

HOTSPOT JA facilitates ticket sales for live events in Jamaica. When you purchase a ticket:
All payments are processed by WiPay Financial (wipayfinancial.com). By making a purchase, you agree to WiPay's terms and privacy policy. HOTSPOT JA is not responsible for payment failures, delays, or errors arising from WiPay's processing systems.
Your Rights Under the Jamaica Consumer Protection Act: If an event is cancelled by the organiser, you are entitled to a full refund of your ticket purchase price.

Event hosts who list events and sell tickets via HOTSPOT JA are solely responsible for:
HOTSPOT JA acts as a marketplace platform only and is not the event organiser. HOTSPOT JA's liability to ticket buyers is limited to facilitating the refund process in the event of organiser non-compliance.
HOTSPOT JA currently provides its core discovery and listing services free of charge. A service fee may apply to ticket transactions. Any applicable fees will be clearly displayed before you complete your purchase.
We do not warrant that:
We do not endorse, warrant, or guarantee any events, products, services, or content provided by third parties. Any reliance on such content is at your sole risk.
We are not responsible for user conduct, interactions, or disputes. You are solely responsible for your interactions with other users and third parties.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, OR (B) ONE HUNDRED DOLLARS (USD $100 OR JMD EQUIVALENT).
HOTSPOT HAS NO LIABILITY WHATSOEVER FOR:
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless HOTSPOT and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Before filing any formal dispute, you agree to contact us at Hotspotapp876@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve disputes amicably within 30 days.
If informal resolution fails, disputes may be resolved through binding arbitration in accordance with Jamaica's Arbitration Act or other mutually agreed procedures, rather than in court.
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class action, consolidated action, or representative action.
Notwithstanding the above, HOTSPOT may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of our intellectual property rights or to enforce confidentiality obligations.
These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law principles.
You agree to submit to the exclusive jurisdiction of the courts located in Kingston, Jamaica, for the resolution of any disputes arising from these Terms or your use of the Service.
To the extent permitted by law, you waive any right to a jury trial in any proceeding arising out of or related to these Terms.
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and HOTSPOT regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms and your account to any successor entity without your consent in connection with a merger, acquisition, or sale of assets.
HOTSPOT shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, fuel, energy, labor, or materials.
The following provisions shall survive termination of these Terms: Intellectual Property Rights, Content Licenses, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.
The section and subsection headings are for convenience only and do not affect the interpretation of these Terms.
These Terms are drafted in English. Any translations are provided for convenience only. In the event of any conflict between the English version and a translation, the English version shall prevail.
By using the Service, you consent to receive electronic communications from us, including via email, push notifications, or in-app messages. These communications may include notices about your account, transactional information, and marketing messages (which you may opt out of).
We reserve the right to modify, update, or replace these Terms at any time at our sole discretion.
Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account.
